Karmaura is owned and operated by Alana Kilpatrick ABN 22448498010 which provides online yoga services, focused on pre-recorded Instructional videos and tutorials which provide knowledge, techniques, and skills to assist prenatal women during their pregnancy (Online Prenatal Yoga series, Free yoga videos for pregnancy).
I warrant that all information I provide to Karmaura, including any information I provide in the course of completing the online registration process is complete, up to date and accurate and I agree to inform Karmaura promptly if there are any changes. I acknowledge that any changes to the information provided may affect the Services Karmaura is providing.
I hereby waive and release, indemnify, hold harmless and forever discharge Karmaura and its affiliates, directors, officers, employees, contractors, volunteers or agents (Personnel) of and from any and all claims, demands, debts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the Instructional videos, tutorials, events or Services conducted by Karmaura and/or its Personnel, on or off the online website Services platform.
I acknowledge, agree and warrant that the Services provided by Karmaura are no substitute for medical advice and does not guarantee against injury or death. I understand that the Services, in which I will participate, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of myself, my heirs, assigns, administrators, executors and next of kin, I waive all claims of damage, injuries and death sustained to me or my property, that I may have against the aforementioned release party to such Services, including claims in tort, contract, equity or otherwise.
I acknowledge, agree and warrant that I have obtained medical advice from a certified health care provider and confirm I am in good health and in proper physical condition to participate in the Services. I acknowledge, agree and understand that participating in the Services requires physical movements that may result in injury, both serious and/or disabling which is inherently present and cannot be entirely eliminated or avoided. I accept full responsibility for all injuries and damage sustained as a result of participating in the Services and I agree and warrant that if at any time I experience any pain or discomfort and believe conditions to be unsafe, I will immediately discontinue further participation in the Services.
I voluntarily assume any and all risks and take full responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur, on or off the online website Services platform, in connection with usage of any household items used as props when participating in the Services are warranted by the participant to be used at their own personal risk and all claims of liability as to damage to personal property is waived to the full extent by law.
This form contains the entire agreement between the parties and supersedes any prior written or oral agreements between them concerning the subject matter of this waiver and release. The provisions of this waiver and release may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.
The provision of this waiver and release will continue in full force and effect even after the termination of the Services conducted by and/or for the benefit of Karmaura, whether by agreement, by operation of law, or otherwise.
I have read, understood and fully agree to the terms of this waiver and release. I understand and confirm that by selecting/clicking ‘I Accept’ or ‘I Agree’ at the bottom of this waiver and release, I certify that I have voluntarily accepted and agree to be bound by this waiver and release form and unconditionally release the Personnel from all future liability to the greatest extent allowed by law.
I certify that I am 18 years or older and have read this document and fully understand it OR as a parent or guardian of the participant (a) I agree to the above for myself and on behalf of the participant and (b) I indemnify and will keep Indemnified any person or body directly or indirectly associated with the conduct of the exercise on the terms referred to.
